Introduction

On Monday, December 5th, 2022, the court convened under the presidency of Judge Shahab Abdul Rahman Al-Hamadi, with the participation of Judges Hassan bin Arabi Faydi and Jumaa Ibrahim Mohammed Al-Otaibi. The case was brought about due to the property owner’s failure to pay rent, and doubt was cast on the credibility of the witness’s testimony due to a previous lawsuit filed against him for non-payment of rent. It was also mentioned that a letter from the Land Registration Department confirmed the relinquishment of the property by the heirs of both parties in favor of their minor daughter.

Based on legal principles, the appeal was accepted, and the appealed judgment rejecting the claimants’ suit was overturned. Subsequently, the final decision was appealed in cassation under appeal No. 1174/2021 Civil. 

It is important to mention here the significance of having accurate and comprehensive judgments that include all factors and facts related to the case. Ignoring any legal element that can affect the case can lead to the destruction of justice.
